John Ho was quoted in a Business Insurance article discussing a virtual public hearing hosted by the U.S. Department of Labor on a proposed federal workplace heat safety standard introduced by the Biden administration in August 2024. The proposed rule would require employers across a wide range of industries to implement heat hazard control measures—such as acclimation periods, rest breaks, shade provisions, and recordkeeping—when workplace temperatures exceed 80 degrees.
“That contrast (in opinions) is not anything unexpected. What surprised some of us is that OSHA set this public hearing during the Biden administration, and it’s taking place.” John noted. In January, the Trump administration temporarily halted rulemaking but allowed public hearings on the heat standard by April. Many believe that if federal efforts stall, individual states and local governments, some of which have already introduced their own heat rules, will take the lead.
