Jerry Goldfeder was quoted in a New York Law Journal article discussing the U.S. Supreme Court ruling that will keep New York City’s lone Republican-held congressional district intact for the midterms in November. This ruling sets a precedent by weighing in before a mid-level state appellate court could issue a holding on legal questions. It would be “totally inappropriate for the Supreme Court to weigh in before the state courts resolved the matter,” said Jerry. “The scathing dissent” by Justice Sonia Sotomayor “points out that this is the first time the U.S. Supreme Court has ignored the regular state court processes.” He added, "having said that, it was inevitable from the get-go that they would do so. I've always believed that given the timing of this lawsuit," filed in late October, "the Supreme Court would stay Judge Pearlman's decision.”
