Joseph Sirbak was quoted in a Law360 article discussing the National Mediation Board’s (NMB) recent ruling that SpaceX falls within its jurisdiction. The NMB’s memo effectively places SpaceX and its employees under the same labor relations system as airlines and railroads, imposing higher barriers for worker unionization and lowering organizing protections. At the same time, this ruling raises the legal stakes for SpaceX because employers can seek damages in court.
Joe explained why the Railroad Labor Act, which makes it much harder for workers to strike, was introduced in 1926, stating: “The Railway Labor Act came about following repeated rail strikes, and the entire purpose of the Railway Labor Act was to prevent strikes, prevent interruptions to commerce.”
