Employers, Beware: Suits Sprout Over Workplace Discussion of Israel-Hamas War

Susan Eisenberg was quoted in a Law.com article discussing the rise in employment-related lawsuits connected to workplace conflicts over the Israel-Hamas war, as employees express support for either side and face backlash from colleagues or supervisors.

“I do think this is something that employers need to get a handle on when these things arise. They have the right to do so. Employers, to a certain extent, can restrict political speech in the workplace, with the caveat that you want to make sure that you're complying with all your state and local laws," Susan explained.

Additionally, certain elements of political speech in the workplace fall under the jurisdiction of the National Labor Relations Act, according to Eisenberg. She emphasized that employers need to enforce policies consistently across all groups and should provide training for employees, including sensitivity training.
