Florida Supreme Court Clarifies Retaliation Standard Under Private Whistleblower Act [Alert]

Jonathan Orbis and Arielle Eisenberg discuss the Florida Supreme Court ruling that, under the state’s Private Whistleblower Act, employees must prove the employer’s conduct is actually unlawful, not merely reasonably believed to be, while clarifying that a completed or adjudicated violation is not required to sustain a retaliation claim.

Jonathan focuses his practice on labor and employment matters and joined the firm after serving as a summer associate in 2025. He also held roles at Miami-Dade County and the State Attorney’s Office, managing operations and driving process improvements for special taxing districts and child support enforcement.

During law school, Jonathan gained experience as a judicial extern to the Honorable Beth Bloom of the U.S. District Court for the Southern District of Florida and as a judicial intern to the Honorable Fleur J. Lobree of the Florida Third District Court of Appeal.

Jonathan earned his J.D., summa cum laude, from Florida International University College of Law in 2025, where he served on the FIU Law Review and received the CALI Excellence for the Future Award in Computer and Internet Law. He also received CALI awards in Criminal Procedure: Investigation, and Legal Research and Writing III. Additionally, Jonathan was a member of the Cuban American Bar Association and the Employment and Labor Law Society. Jonathan received both his B.A., cum laude, and his M.A., summa cum laude, from Florida International University.
