Daniel Johns was quoted in a SHRM article discussing the National Labor Relations Board (NLRB)’s landmark decision, Cemex Construction Materials Pacific, LLC. This decision, which made it notably easier for unions to get representational rights over a workforce, remains in place despite the board regaining a quorum.
The NLRB currently has a quorum of three members but not the full complement of five. While a quorum of three can issue new decisions, Daniel Johns explained that “the board has historically only overturned NLRB precedent with three votes as opposed to two…the Republican majority on the board likely will not overturn any cases without additional appointments. It is unclear when or if such appointments will be made.”
