Cozen O’Connor represents public and private employers in all aspects of traditional labor law. Given the recent resurgence in labor organizing, attorneys work closely with both union and non-union workplaces to facilitate positive labor relations and advocate for management-side interests.
Labor law requires specific legal and procedural knowledge, as well as an understanding of the unique dynamics and norms governing the management-labor relationship. Cozen O’Connor has lawyers with decades of experience, including a former associate general counsel of the National Labor Relations Board (NLRB), and among the deepest labor benches in the Am Law 100.
Employers in a diverse range of industries—health care, higher education, public sector, railway, manufacturing, retail, hospitality, telecommunications—rely on Cozen O’Connor to guide them through every aspect of labor relations and dispute resolution.
Union Organizing
Cozen O’Connor helps employers navigate and respond to modern labor organizing strategies in a post-Cemex world. Attorneys regularly represent employers in response to recognition petitions, unit clarification petitions and decertification petitions, including advising on NLRA compliance during and after the election cycle. We evaluate workforce relations and provide recommendations on how to limit third-party involvement in the employment relationship and foster positive employer-employee relations.
Collective Bargaining Negotiations
We lead high-stakes contract negotiations and interest arbitrations on behalf of public and private sector employers with national, regional, and local bargaining units. In addition to successor contracts, we have deep experience in negotiating first contracts. We have demonstrated an ability to devise win-win agreements that ensure the long-term success of the enterprise as a whole.
Grievance Arbitrations
We represent employers in grievances filed by both unions and individual employees alleging collective bargaining agreement violations. Attorneys lead thorough but efficient investigations, seek mutually agreeable resolution of claims, and have an impressive track record of success at arbitration.
NLRB Proceedings
Cozen O’Connor represents clients in proceedings at the NLRB, including election petitions and unfair labor practice charges. Attorneys respond to charges, lead investigations, lead agency administrative trials, and argue before federal circuit courts.
Strikes & Lockouts
We work with employers to prevent work stoppages and lead contingency planning. When a strike or lockout becomes unavoidable, Cozen O’Connor provides crisis-tested counsel on strategic communications, operational continuity, and legal proceedings and injunctions.
Labor/Management Relations
Fostering positive labor/management relations is a priority in every aspect of our traditional labor practice—whether responding to strike threats, consulting on an employee’s termination, or helping employers exercise their management rights. We advise clients on the applicable laws and best practices from a labor-relations standpoint.
