Brian works to address and resolve issues regarding cable, broadband, wireless, and telecommunications providers. Brian has experience drafting and negotiating communications franchises and licenses, pole attachment agreements, right-of-way ordinances, tower leases, IRU agreements, vendor contracts, and related agreements with a broad spectrum of entities. He also advises clients on state and local permitting, franchise fees, utility taxes, state and federal requirements and policies, including Title II and Title VI of the Federal Communications Act, FCC regulations, agreements for communications service to multi-tenant residential (MDU/MTE) and commercial properties, and a variety of construction standards and regulatory requirements in the communication field.
Brian provides counsel on regulatory compliance and transactional opportunities to entities across the nation in their complex contract negotiations and regulatory proceedings. He has a wide range of experience in highly regulated sectors with particular emphasis on government and technology agreements and a variety of other commercial transactions.
Government Contracting: Government policies and regulatory issues present both challenges and opportunities. Brian combines industry knowledge and government insight with regulatory and legal experience so that he can advise clients regarding the issues arising at the convergence of government, business, and the law. Brian offers practical advice to further his clients’ objectives and reach a win-win resolution. He strives to maintain expectations and build a relationship between parties that will often work together following contract negotiations.
Technology Transactions: Brian structures and negotiates custom transactions in the areas of information technology, including managed services and enterprise software licensing. Brian represents software solutions providers in contract negotiations and with both public and private sector customers across the country. He has assisted clients with technology contracting needs, including pension system implementation and contract compliance. He has drafted and negotiated numerous license agreements, software maintenance agreements, and services agreements, including terms of services, master service agreements, service level agreements, and privacy policies.
Wireless Infrastructure, Wireless Facilities Siting: Brian represents private property landlords and local governments on cell siting issues, including cell towers, water tower leases, ground leases, rooftop leases, wireless infrastructure, and wireless facilities siting. He drafts and negotiates wireless ordinances and advises clients on federal and state rules for permit application processing in connection with deploying wireless telecommunications infrastructure. Brian regularly presents at state and national conferences on right of way management, cell tower leasing, and pole attachment contracting.
Brian joined Cozen O'Connor in 2026 along with his colleagues from Moss & Barnett, where he was a member of the board of directors (2009-2025) and served as president and chief executive officer (2017-2025). He earned his B.A. in mathematics from Creighton University and his J.D. from William Mitchell College of Law, where he was the editor of the William Mitchell Law Review.
